Sagaponack Village has announced its decision not to contest a lawsuit challenging its coastal development restrictions. Curbed readers will recall that Anthony G. Petrello filed suit back in September claiming Sagaponack's coastal erosion zoning law?the one keeping him from building a new 4500 sq. ft home?was "outside of their power as municipality." After consulting with the town's lawyer, Mayor Don Louchheim said, "We are not going to expend taxpayer funds to justify something that the [Department of Environmental Conservation] made us do." The decision to argue the lawsuit now falls upon the DEC. [27 East]
